An Act to Amend the Executive Council Act

His Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

Executive Council Act

1 Section 2 of the Executive Council Act, chapter 152 of the Revised Statutes, 2011 is repealed and the following is substituted:

Appointment of Ministers

2 Under the Great Seal of the Province, the Lieutenant-Governor in Council may appoint from among the members of the Executive Council the following Ministers who shall hold office during pleasure: a President of the Executive Council, a Minister of Agriculture, Aquaculture and Fisheries, a Minister of Education and Early Childhood Development, a Minister of Environment and Climate Change, a Minister of Finance and Treasury Board, a Minister of Health, a Minister of Indigenous Affairs, a Minister of Intergovernmental Affairs, a Minister of Justice who shall also be Attorney General, a Minister of Local Government, a Minister of Natural Resources, a Minister of Post-Secondary Education, Training and Labour, a Minister of Public Safety, a Minister of Social Development, a Minister of Tourism, Heritage and Culture, and a Minister of Transportation and Infrastructure.

TRANSITIONAL PROVISIONS

References to Ministers

2( 1) When in an Act other than this Act or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister of Natural Resources and Energy Development, it shall be read, unless the context otherwise requires, as a reference to, as the case may be,

(a) the Minister of Natural Resources, or

(b) the member of the Executive Council designated by the Lieutenant-Governor in Council as being responsible for Energy.

2( 2) When in an Act other than this Act or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister of Service New Brunswick, it shall be read, unless the context otherwise requires, as a reference to the member of the Executive Council designated by the Lieutenant-Governor in Council as being responsible for Service New Brunswick.

Confirmation and ratification

3( 1) Any act or thing done from November 4, 2024, to the date of the enactment of this section, both dates inclusive, by the Minister of Intergovernmental Affairs or the Minister of Natural Resources in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on that Minister with respect to any Act, or any particular matter or thing under the administration, supervision or control of that Minister,

(a) is deemed to have been done by a person validly appointed to exercise or perform the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on that Minister,

(b) is deemed to constitute a valid exercise or performance of the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on that Minister, and

3( 2) Nothing in paragraphs (1)(a) and (b) shall be taken as providing any indication that any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the Minister of Intergovernmental Affairs or the Minister of Natural Resources was not validly exercised or performed.

Appointment, confirmation and ratification – deputy head

4( 1) The Lieutenant-Governor in Council may make the initial appointment of a deputy head under section 3 of the Civil Service Act retroactive to November 4, 2024, for the Department of Intergovernmental Affairs.

4( 2) Any act or thing done by the deputy head appointed in accordance with subsection (1) from November 4, 2024, to the date of the enactment of this section, both dates inclusive, in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on that deputy head

(b) is deemed to constitute a valid exercise or performance of the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on that deputy head, and

4( 3) Nothing in paragraphs (2)(a) and (b) shall be taken as providing any indication that any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the deputy head appointed in accordance with subsection (1) was not validly exercised or performed.

Immunity

5 If the Ministers, deputy head or other persons acted in good faith in doing the act or thing, no action, application or any other proceeding to question or in which is questioned the validity of the appointment of the Ministers referred to in subsection 3(1) or the deputy head appointed in accordance with subsection 4(1), or the authority of the Ministers or the deputy head to act in that capacity, lies or shall be instituted against

(a) the Crown in right of the Province,

(b) the Ministers with respect to any act or thing done from November 4, 2024, to the date of the enactment of this section, both dates inclusive, by the Ministers in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the Ministers with respect to any Act, or any particular matter or thing under the administration, supervision or control of the Ministers,

(c) the deputy head with respect to any act or thing done by the deputy head from November 4, 2024, to the date of the enactment of this section, both dates inclusive, in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the deputy head, or

(d) any other person appointed, assigned, designated or requested to assist the Ministers or the deputy head regarding the administration, supervision or enforcement of any Act with respect to which any right, power, duty, function, responsibility or authority is transferred to, vested in or imposed on the Ministers, regarding a particular matter or thing under the administration, supervision or control of the Ministers, or regarding any right, power, duty, function, responsibility or authority that is transferred to, vested in or imposed on the deputy head, with respect to any act or thing done, within the meaning of this paragraph, by the other person.

CONSEQUENTIAL AMENDMENTS

Assessment Act

6 Paragraph 4(1)(i) of the Assessment Act, chapter A-14 of the Revised Statutes, 1973, is amended by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”.

Bituminous Shale Act

7 Section 1 of the Bituminous Shale Act, chapter B-4.1 of the Acts of New Brunswick, 1976, is amended in the definition “Minister” by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”.

Regulation under the Business Corporations Act

8 Section 11 of New Brunswick Regulation 81-147 under the Business Corporations Act is amended

(a) in subparagraph (1)(a)(i) by striking out “Minister of Service New Brunswick” and substituting “member of the Executive Council designated by the Lieutenant-Governor in Council as being responsible for Service New Brunswick”;

(b) in subparagraph (2)(a)(i) by striking out “Minister of Service New Brunswick” and substituting “member of the Executive Council designated by the Lieutenant-Governor in Council as being responsible for Service New Brunswick”.

Cannabis Education and Awareness Fund Act

9 Section 1 of the Cannabis Education and Awareness Fund Act, chapter 4 of the Acts of New Brunswick, 2018, is amended by repealing the definition “Minister” and substituting the following:

“Minister” means the member of the Executive Council designated by the Lieutenant-Governor to administer this Act and includes any person designated by the member to act on the member’s behalf. (ministre)

Cannabis Management Corporation Act

10( 1) Section 2 of the Cannabis Management Corporation Act, chapter 3 of the Acts of New Brunswick, 2018, is amended by repealing the definition “Minister” and substituting the following:

“Minister” means the member of the Executive Council designated by the Lieutenant-Governor in Council as being responsible for Cannabis NB Ltd. and includes any person designated by the member to act on the member’s behalf. (ministre)

10( 2) Section 19 of the Act is amended by striking out “Minister” and substituting “Minister of Finance and Treasury Board”.

10( 3) Paragraph 28(2)(c) of the English version of the Act is amended by striking out “Minister” and substituting “Minister of Health”.

Regulation under the Cannabis Management Corporation Act

11 Subsection 6(1) of New Brunswick Regulation 2018-59 under the Cannabis Management Corporation Act is amended by striking out “Minister” and substituting “Minister of Finance and Treasury Board”.

Regulation under the Civil Service Act

12 Section 3 of New Brunswick Regulation 93-137 under the Civil Service Act is amended by adding the following in alphabetical order:

Clean Environment Act

13( 1) Section 1 of the Clean Environment Act, chapter C-6 of the Revised Statutes, 1973, is amended

(a) by repealing the definition “Minister of Natural Resources and Energy Development”;

(b) by adding the following definition in alphabetical order:

“Minister of Natural Resources” means the Minister of Natural Resources and includes a person designated by the Minister of Natural Resources to act on that Minister’s behalf; (ministre des Ressources naturelles)

13( 2) Section 6.1 of the Act is amended

(a) in subsection (2) by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”;

(b) in subsection (3) by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”;

Common Business Identifier Act

15 Section 1 of the Common Business Identifier Act, chapter 128 of the Revised Statutes, 2011, by repealing the definition “Minister” and substituting the following:

“Minister” means the member of the Executive Council designated by the Lieutenant-Governor in Council as being responsible for Service New Brunswick. (ministre)

Conservation Easements Act

16 Section 1 of the Conservation Easements Act, chapter 130 of the Revised Statutes, 2011, is amended in paragraph (b) of the definition “Minister” by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”.

Crown Lands and Forests Act

17 Section 1 of the Crown Lands and Forests Act, chapter C-38.1 of the Acts of New Brunswick, 1980, is amended in the definition “Minister” by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”.

Regulation under the Crown Lands and Forests Act

18 Form 1 of New Brunswick Regulation 86-160 under the Crown Lands and Forests Act is amended

(a) in the portion following “BACKGROUND” by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”;

(b) in the portion preceding “In the presence of:” by striking out “COUNTERSIGNED by the Minister of Natural Resources and Energy Development” and substituting “COUNTERSIGNED by the Minister of Natural Resources”;

19 Section 1 of the Electricity Act, chapter 7 of the Acts of New Brunswick, 2013, is amended by repealing the definition “Minister” and substituting the following:

“Minister” means the member of the Executive Council designated by the Lieutenant-Governor in Council as being responsible for Energy and includes any person designated by the member to act on the member’s behalf. (ministre)

Energy and Utilities Board Act

20( 1) Section 1 of the Energy and Utilities Board Act, chapter E-9.18 of the Acts of New Brunswick, 2006, is amended by repealing the definition “Minister” and substituting the following:

“Minister” means the member of the Executive Council designated by the Lieutenant-Governor in Council as being responsible for Energy. (ministre)

20( 2) Paragraph 50(2)(d.2) of the Act is amended by striking out “Minister of Natural Resources and Energy Development” and substituting “the Minister of Natural Resources”.

Energy Efficiency Act

21 Section 1 of the Energy Efficiency Act, chapter 149 of the Revised Statutes, 2011, is amended by repealing the definition “Minister” and substituting the following:

Evidence Act

22( 1) Section 39 of the Evidence Act, chapter E-11 of the Revised Statutes, 1973, is amended by striking out “Minister of Natural Resources and Energy Development” wherever it appears and substituting “Minister of Natural Resources”.

22( 2) The heading “Certificate of Minister of Natural Resources and Energy Development” preceding section 40 of the Act is amended by striking out “and Energy Development”.

22( 3) Section 40 of the Act is amended by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”.

Exotic Animals Act

23 Subsection 1(1) of the Exotic Animals Act, chapter 52 of the Acts of New Brunswick, 2017, is amended in the definition “Minister” by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”.

Regulations under the Financial Administration Act

24( 1) Schedule A of New Brunswick Regulation 83-227 under the Financial Administration Act is amended by adding the following in alphabetical order:

27 Section 1 of the Forest Fires Act, chapter 110 of the Revised Statutes, 2014, is amended in the definition “Minister” by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”.

Forest Products Act

28 Section 1 of the Forest Products Act, chapter 105 of the Revised Statutes, 2012, is amended in the definition “Minister” by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”.

Gas Distribution Act, 1999

29 Section 1 of the Gas Distribution Act, 1999, chapter G-2.11 of the Acts of New Brunswick, 1999, is amended by repealing the definition “Minister” and substituting the following:

Regulation under the Gasoline and Motive Fuel Tax Act

30 Paragraph 18.1(1)(e) of New Brunswick Regulation 82-81 under the Gasoline and Motive Fuel Tax Act is amended in the portion preceding subparagraph (i) by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”.

Inquiries Act

Metallic Minerals Tax Act

35( 1) Subsection 1(1) of the Metallic Minerals Tax Act, chapter M-11.01 of the Revised Statutes, 1973, is amended in the definition “date of commencement of production” by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”.

35( 2) Subsection 10(4) of the Act is amended by striking out “Minister of Natural Resources and Energy Development” wherever it appears and substituting “Minister of Natural Resources”.

Mining Act

36 Section 1 of the Mining Act, chapter M-14.1 of the Acts of New Brunswick, 1985, is amended in the definition “Minister” by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”.

New Brunswick Liquor Corporation Act

40( 1) Section 1 of the New Brunswick Liquor Corporation Act, chapter 105 of the Revised Statutes, 2016, is amended by adding the following definition in alphabetical order:

“Minister” means the member of the Executive Council designated by the Lieutenant-Governor in Council as being responsible for the Corporation. (ministre)

40( 2) Section 8 of the Act is amended

(a) in subsection (6) by striking out “Minister of Finance and Treasury Board” and substituting “Minister”;

(b) in the definition “all-terrain vehicle managed trail” by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”.

41( 2) Section 7.8 of the Act is amended

Oil and Natural Gas Act

42 Section 1 of the Oil and Natural Gas Act, chapter O-2.1 of the Acts of New Brunswick, 1976, is amended in the definition “Minister” by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”.

Parks Act

43( 1) Section 1 of the Parks Act, chapter 202 of the Revised Statutes, 2011, is amended

(a) in paragraph (b) of the definition “Minister” by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”;

(b) in the portion following paragraph (c) of the definition “provincial park” by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”.

Regulation under the Partnerships and Business Names Registration Act

44 Subparagraph 2(a)(i) of New Brunswick Regulation 81-35 under the Partnerships and Business Names Registration Act is amended by striking out “Minister of Service New Brunswick” and substituting “member of the Executive Council designated by the Lieutenant-Governor in Council as being responsible for Service New Brunswick”.

Petroleum Products Pricing Act

45 Section 1 of the Petroleum Products Pricing Act, chapter P-8.05 of the Acts of New Brunswick, 2006, is amended by repealing the definition “Minister” and substituting the following:

“Minister” means the member of the Executive Council designated by the Lieutenant-Governor in Council as being responsible for Energy. (ministre)

Pipeline Act, 2005

46 Section 1 of the Pipeline Act, 2005, chapter P-8.5 of the Acts of New Brunswick, 2005, is amended by repealing the definition “Minister” and substituting the following:

“Minister” means the member of the Executive Council designated by the Lieutenant-Governor in Council as being responsible for Energy. (ministre)

Private Woodlot Sustainability Act

47 Section 1 of the Private Woodlot Sustainability Act, chapter 47 of the Acts of New Brunswick, 2022, is amended in the definition “Minister” by striking out “Minister of Natural Resources and Energy Development” and substituting “Minister of Natural Resources”.

Procurement Act

48 Section 1 of the Procurement Act, chapter 20 of the Acts of New Brunswick, 2012, is amended by repealing the definition “Minister” and substituting the following:

“Minister” means (ministre)

(a) for the purposes of sections 3, 8, 17, 18 and 26, the member of the Executive Council designated by the Lieutenant-Governor in Council as being responsible for Service New Brunswick and does not include any person designated by the member to act on the member’s behalf, and

(b) for the purposes of the other provisions of this Act, the member of the Executive Council designated by the Lieutenant-Governor in Council as being responsible for Service New Brunswick and includes any person designated by the member to act on the member’s behalf.

Protected Natural Areas Act
